Mediation. It’s time to move on.

We love the law. We love to litigate. One of the best lessons we have learned as a litigators is mediation is the best solution the law has to offer. Not litigation.

Every case is different. But quite often every case is the same. Let us explain. Generally speaking all litigation begins with conflict. Conflict by its nature is adversarial. Each side taking respective opposing positions and hanging on for dear life. Out of principal. Out of emotion. Or in many cases, just because. While it may be litigation involving a complex construction project, a multi-million-dollar commercial real estate transaction, custody, a job loss, discrimination, a prenuptial dispute, a civil rights claim resulting from death while in the custody of the state, divorce, a car accident, a non-compete, an unpaid bill, all pieces of litigation with different facts giving rise to the same thing, a conflict.

This conflict begins the long arduous process known as litigation. Litigation is guaranteed to have one result for both partieslarge legal expenses. Litigation is guaranteed to take months if not years. Litigation is guaranteed to be out of your control. You will sit and pay legal fees. Wait. And finally, be unable to control the outcome despite the amount of money and time poured into the process.
